Summary/Abstract: In the light of Article 190(3) of the Constitution of the Republic of Poland, the Constitutional Tribunal may defer the date on which an unlawful normative act ceases to be binding. According to the view prevailing in legal scholarly writing, one of the consequences of the Constitutional Tribunal’s exercise of the aforementioned competence is the exclusion of a public authority’s liability for damages. However, the said view raises numerous doubts of an axiological and dogmatic nature. The aim of this article is to analyse in detail the arguments for and against the exclusion of a public authority’s liability for damages as a result of a deferment of the date when a normative act ceases to be binding. The conclusions of this analysis confirm the concern expressed in legal scholarly writing and decisively oppose the aforementioned prevailing view.
