Summary/Abstract: In this case, the Italian Constitutional Court resolved a dispute over powers between the Senate of the Italian Republic and the Common Court – 4th Criminal Division in Catania with regard to the scope of protection afforded by parliamentary immunity. The Common Court challenged the Senate’s resolution, which classified a senator’s offensive Facebook posts as protected under parliamentary immunity. The Constitutional Court held that the Senate had exceeded its powers by interfering with the judiciary’s competences. As a result, the Senate’s resolution was repealed.
