Summary/Abstract: The European Commission, as the “guardian of the Treaties,” is the institution responsible for ensuring that EU law is properly respected by the member states. Failure to comply with this obligation allows the Commission to initiate formal infringement proceedings against them, with the aim of bringing national laws and practices in line with EU law. If the state concerned does not comply with the reasoned opinion within the period set by the Commission, the Commission may refer the matter to the Court of Justice of the European Union.
