Summary/Abstract: The existence and use of private military and security companies is not only a growing trend and the modus operandi of the strategic action of individual actors of international relations, but also a concrete challenge to the generally accepted norms of international law derived from the UN Charter, as well as to international humanitarian law and international human rights standards. The activity of private military and security companies is closely related to certain rights of states arising from international treaty law and international customary law. The activity of PMSCs is often found in a kind of “gray zone” of imprecisely defined legal norms and the real needs of certain state and non-state actors. Because of this factual situation, it is necessary to analyze the relationship between the existence and operation of PMSCs and international law, as well as the impact of these actors on the sovereignty of the state and the state’s right to self-defense. In addition, it is necessary to analyze the dangers and risks arising from the activities of PMSCs as well as the possible positive security aspects of their activities.
