6. About the correct interpretation of art. 1579 paragraph (3) of the civil Code of 1864

Summary/Abstract: The assimilation, in case of a consumption loan, of the gold and silver coins with the money without any circulating power within the Romanian territory, more specifically with a certain currency, even if it solves the problem related to the conversion of foreign currency loan into lei, does not justify the solution of making the payment of the loan installments in lei at an exchange rate kept frozen at the level of that available upon granting the loan, as in compliance with art. 1579 paragraphs (2) and (3), it shall be taken into account to repay the same amount as that borrowed or its equivalent value on the due date, but not on the date of granting the loan.
