3. Interdiction to cumulate pensions with incomes from a lucrative activity. Conditions and effects. Synthesis of judicial practice

Summary/Abstract: Law no. 263/2010 on public pension system regulates a common case of payment suspensions for different pension categories respectively early retirement pension and disability pension. This case of payment suspensions constitutes in reality an interdiction to cumulate the benefit of this kind of pensions with incomes from a lucrative activity with some exceptions. This article presents jurisprudential solutions to some problems generate by the enforcement of those legal provisions regarding the conditions to be met in order to conclude that this interdiction was infringed with the consequences of payment suspensions and the date the suspension operates. The article also presents relevant case law of European Court of Human Rights.
