11. The patrimonial liability of the employee. Passive capacity to stand trial of the legal successors of deceased employee

Summary/Abstract: As regards the circumstance in which the legal successors of an employee have or not the passive capacity to stand trial in a lawsuit whose object is represented by an action in patrimonial liability brought before the court by the employer, only those rules in the matter of the transfer of assets of the succession provided by the Civil Code are relevant, being applicable according to art. 278 paragraph (1) of the labor Code, given the common law role of the civil laws.
