Summary/Abstract: Article 19 of the Agricultural Land Ownership and Use Act (ALOUA) establishes an original title of acquisition in favor of the municipality regarding agricultural lands located within its territory. This applies to lands which, prior to the formation of Labor Cooperative Farms (TKZS) or State Agricultural Farms (DZS) in a given settlement, were owned by natural persons or legal entities other than the municipality, provided that no application for the restoration of ownership rights under Art. 11, para. 1 of ALOUA was filed by August 5, 1992, and no claim under Art. 11, para. 2 of ALOUA was brought by May 13, 2007.The municipality acquires the right of ownership over these agricultural lands as of the later of the following dates: the entry into force of the land redistribution plan, or the entry into force of the act approving the map of existing and restorable old physical boundaries. In disposing of such lands, the municipality must first satisfy specific needs prescribed by law; only thereafter is it free to exercise its right of ownership within the limits set forth in Article 140 of the Constitution.
