Summary/Abstract: The obligation of information involves the communication to the consumer, of all the information needed for the conclusion of the agreement by expressing a valid consent. By the regulation of the obligation of information, the legislator has intervened in favor of the clients during this stage, as an informational imbalance exists, since the purpose is to protect the consumer’s consent. The advisory obligation is also incumbent on banks, which sometimes is deemed as different from the obligation of information, since the former supposes a value judgment, and the latter only involves the communication of certain strict information intended to allow the customer the make the decision that he considers appropriate.
