Summary/Abstract: The classification into the first work category is conditional, on one hand, upon the nomination made by the employing unit, and on the other hand, upon actually carrying on one of the activities among those provided by appendix no. 1 to the Order no. 50/1990, respectively by appendix no. 1 to the Order no. 125/1990. The differentiation in terms of classification into work categories shall not be made only depending on the hazardousness of the activity performed, but also depending on several factors provided by art. 6 of the Order no. 50/1990. The fact that the hazardousness condition is met shall not represent itself the basis for the classification into the first work category, if the other conditions are not met.
