11. Concession agreement of the medical practice. Termination. Conditions

Summary/Abstract: The legal regime of the medical practices is further regulated by the provisions of the Government Decision no. 884/2004, representing the special provision in the matter, as supplemented by the provisions of the Government Emergency Ordinance no. 54/2006. Consequently, in case of termination of a concession agreement of a medical practice as a result of the non-observance of the obligation to carry on the activity, it is not required to promote any agreement termination action according to art. 57 paragraph (1) letter c) of the Government Emergency Ordinance no. 54/2006, but the grantor may decide to terminate the agreement for convenience according to art. 5 paragraph (3) letter f) of the Government Decision no. 884/2004, and this act shall be subject to the censorship of the court of law under Law no. 554/2004.
