Summary/Abstract: The institution of the limitation period for criminal liability has received particular attention in the criminal cases landscape, especially after 2018, with the qualified intervention of the Constitutional Court regarding the provisions of art. 155 paragraph (1) of the Penal Code. regarding the interruption of the limitation period for criminal liability by performing „any procedural act in question”, finding the partial unconstitutional nature of these provisions. In this jurisprudential context, the global COVID-19 pandemic, also known as the coronavirus pandemic, caused by the severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2), occurred shortly after, which first determined the issuance of presidential decrees officially declaring this state, initially classified as an emergency, and then as an alert, with the consequence of suspending the resolution of cases pending before the judicial bodies, administrative acts that were then followed by the adaptation of the legislative framework in procedural, civil and criminal matters.Given the predominantly urgent nature of the resolution of criminal cases, the aforementioned decrees provided for certain exceptions to the suspension of the resolution of criminal cases, such as the situation of flagrante delictos – defined by art. 293 of the Code of Criminal Procedure, which contributed to the extension of the limitation period for criminal liability by the duration (2 months) related to the suspension. Although things are apparently clear, in some cases in national jurisprudence the issue of qualifying an act as meeting the conditions of a flagrante delicto in the sense of the criminal process was raised, such as the lack of a procedural act establishing the flagrante delicto, a fact with direct consequences on the fulfillment of the limitation period for criminal liability. This study presents a case study from the recent jurisprudence of the Cluj Court of Appeal, which highlights the importance of analyzing not only the formal conditions required by law for the incidence of flagrant crime situations, an aspect not attributable to the defense, but especially the objective conditions found to be met for the detection of such a crime, with a direct impact on the criminal liability of the defendant. In addition, several other cases with appropriate relevance to the analysis were evoked.
