3. The new regulation of ad-hoc mandate and preventive bankrupt’s certificate – preventing insolvency proceedings

Summary/Abstract: Regardless of their causes, the lack of liquidity and the non-payment of outstanding debts adversely affect the commercial activity as well as the evolution of society as a whole. Because of this, there have always been concerns regarding the prevention and removal of the negative consequences of insolvency. The adoption of the so-called insolvency Code, whose innovative aspects constitute the object of the present study, is part of this approach.
