16. Leaving the scene of an accident. Accident involving property damages only

Summary/Abstract: Concerning the offence of leaving the scene of an accident without the permission of police bodies, the court finds that, according to art. 338 para (3) letter a) of the new criminal Code, leaving an accident scene is not an offence if such accident only involved property damages, which also applies in this case, when the defendant has been sent to trial for the offence in art. 89 para (1) of G.E.O. no. 195/2002, i.e. leaving the scene of an accident involving property damages only. Moreover, according to para (1) of the same legal text, the offence only applies if the accident scene is left without the approval of the police, and there no longer is the requirement that the accident is the result of an offence (in this case, driving under the influence of alcohol).
