Summary/Abstract: The Romanian State has fulfilled its obligation to pay to the claimant the prejudice caused pursuant to the non-enforcement of an order passed by ECHR. The unfulfilled obligation stipulated in the ECHR decision concerned the issue of the ownership title and the claimant’s vesting of possession, obligations resting with the County Land Fund Board and, hence, the objection as to the lack of passive capacity to stand trial of the Romanian Government has been erroneously rejected.
