Summary/Abstract: The aim of the work is to investigate the legal framework of partnership agreements that were used to establish business associations in Serbia in the 19th century. The social and economic circumstances in Serbia, which fought for independence from Ottoman rule in parallel with the development of economic association legal framework, are briefly explained. The subject of attention were the selected characteristics of the partnership as a form of the legal business and economic activity. The partners invested things and effort in the community of goods for the purpose of performing some work of a shorter duration that ended when the work was completed, or for permanently engaging in trade or manufacturing. Partnership, as one of the oldest forms of commercial, financial, agricultural and other activities since the second half of the Roman Republic, was legally regulated in Serbia for the first time in the Serbian Civil Code 1844 with 36 articles. It was investigated which jobs were performed in the form of partnerships on the basis of the Serbian Civil Code 1844 and some later legislation regulating certain activities. There is the analysis of the content of the norms defining partnership, partnership activity and responsibility towards third parties and the form and content of the contract on the establishment of a civil-legal association according to the Serbian Civil Code 1844 and as a contract on the partnership incorporation according to the Serbian Commercial Code 1860. Both types of contracts influenced the association of several persons in business associations in the form of partnerships for the purpose of trading or manufacturing. In addition to reasons of a political and migration nature, craft activities and trade within an independent household meant manufacturing products and providing services intended for the survival of the household craft on the market and no longer for the needs of the family cooperative. This contributed to the gradual expansion of private property and capitalist relations in Serbia in the 19th century.
