3. Procedure of eviction from buildings held without a right. Conditions

Summary/Abstract: Judicial eviction can be achieved either by filing a common law action, or by a special action regulated by Title XI of the new civil procedure Code, namely that provided by art. 1.033 and the following of the new civil procedure Code, the choice belonging to the plaintiff. This special procedure is applicable not only when the parties have concluded a lease agreement, but it also covers the situation in which the building is occupied without a right by a person, with or without the permission or consent of the owner.
