Mutual exercise of parental rights in the context of the amendments to the Family Code, published in the State Gazette No. 115/2025

Summary/Abstract: The current article aims to examine the main amendments to the Family Code, published in the State Gazette No.115/2025, and the reasons that necessitated the above-mentioned changes in the regulations of relations related to the exercise of parental rights and obligations. The content of the concept of “parental rights and obligations” is examined, covering the rights and obligations of parents in relation to minor children, which represents a complex of rights and obligations related to the care of raising children. The main principles are outlined, in compliance with which the exercise of parental rights and obligations should be carried out. Based on the analysis, the main shortcomings of the legal regulation and the practical problems that arise in its application are identified.
