The applicant and the subject of the referral By the Ruling of 18 March 2014 delivered in Case No. 179/122/2014, the Bucharest Court of Appeal – First Criminal Division, in accordance with the provisions of Article 475 of the Code of Criminal Procedure, referred to the High Court of Cassation and Justice – Criminal Division, requesting a preliminary ruling for the principled clarification of the following question of law concerning the application of Article 6(1) of the Criminal Code: “in the case of an attempted offence, should the sentence imposed be reduced to the maximum provided by law for the consummated form, or to the maximum provided by law for the attempted form of the offence?”
