The applicant and the subject of the referral The Ploiești Court of Appeal – Criminal Division and Division for Cases Involving Minors and Family Matters – ordered, by the Ruling of 10 February 2014 in Case No. 289/120/2014 pending before that court, the referral of the High Court of Cassation and Justice pursuant to the provisions of Article 475 of the Code of Criminal Procedure, for the issuance of a preliminary ruling on the principled clarification of the mechanism for applying the more lenient criminal law in cases already finally adjudicated, in the context of a concurrence of offences.
