21. Sanction for non-performance of the employer’s obligation to draft and submit the retirement administrative file of the employee assessed in the invalidity degree category, to the territorial pension house

Summary/Abstract: According to the provisions of item 14 of the Order of the Minister of Labor and Social Security no. 340/2001, the employer, according to the medical decision, drafts the retirement administrative file and sends it, within 10 days, to the territorial pension house. As the respondent did not perform its legal obligation to submit the appellant’s retirement file, the former is required to pay the equivalent value of the invalidity pension which the appellant was deprived of during the period starting on the second day after the submission to the headquarters of the company, of the decision of the assessment in the invalidity degree category and the day when the work relations between the parties were terminated according to the issue of the disciplinary decision of dismissal.
