Summary/Abstract: In compliance with art. 43 of the Law no. 31/1990, the branches are dismem-berments without legal personality, of the companies registered under the law, they can stand trial, according to art. 41 of the Code of Civil Procedure, if authorized in the manner provided for by laws or the regulations that range their capacity or organization. Thus, if the duties of representation of a company were delegated to a branch, it could stand trial for the parent company, as it has the procedural capacity of use, namely the capacity to exercise the procedural rights.
