Summary/Abstract: The transposition of Directive (EU) 2024/1260 into national legislation, by November 2026, brings a series of new concepts that must be incorporated into domestic legislation. The Directive complements the existing European legal instruments, bringing procedures aimed at strengthening the capacity of competent authorities to deprive criminals of the proceeds of criminal activity. In this regard, the Directive brings news features regarding the identification of assets through the silver note, rapid freezing, confiscation not based on a criminal conviction (impeded, for example, by the statute of limitations), as well as unjustified assets related to crime.
