Summary/Abstract: The contractual mechanisms used by the state (lato sensu) implies a complex analysis of the nature and financial implications they have. In this context, this article pursues a detailed approach to the legal nature of the income obtained from the use of these types of contracts. Although the category of contractual means found in the dynamics of public administration (central or local) is an extensive one, our study focuses on two contractual mechanisms, namely the concession contract and the lease contract for state owned assets. These two contractual mechanisms are fundamental in the relations between the public power and the private sector considering that they ensure an efficient use of public resources and contribute to the generation of stable revenues for the general budget. As a result, the present study aims to outline the current perspective on the nature of these revenues, but also to highlight the main aspects that raise uncertainties and create challenges for current research.
