6. Appeal against the decision to validate the decision issued by ANRP in the procedure provided for by Law no. 164/2014

Summary/Abstract: The issuance by the ANRP of a decision to validate or invalidate a decision issued within the framework of the procedure provided for by Law no. 164/2014 gives rise to the beneficiaries' right to challenge the ordered measure, within a period of 30 days from the communication of the decision. In the event that the birth of this right occurs during the resolution of a pending lawsuit, the object of which is to challenge the Commission's decision that was the basis for the ANRP decision, the parties must choose the correct way to exercise the right, including in terms of respecting the legal deadline within which the challenge must be filed. The legal nature of this deadline being that of a limitation period, of procedural law, entails the inapplicability of cases of interruption of the limitation period of the substantive right. Equally, the request to reinstate the exercise of this deadline must be based on justified reasons for which the beneficiaries were unable to exercise the right to challenge within the 30 days provided for by law.
