3. The term to express the option on the inheritance. Legal nature of this term

Summary/Abstract: The right of inheritance option must be exercised within one year from the date of the opening of the inheritance, in accordance with the provisions of Article 1.103 of the Civil Code. The present case under analysis captures the legal nature of the succession option period in the light of the new Civil Code, that of a limitation period. The right of succession option has been defined as a „legal prerogative enabling its holder to be able, by a unilateral act of will, to modify an uncertain legal situation, according to a precise and foreseeable alternative”.
