Summary/Abstract: Forfeiture reflects, in the field of law, the consequences of the passage of time. Whether it concerns substantive law or procedural law, the consequence of failing to exercise a legal prerogative within a certain period of time is the extinction of the right itself. Such a severe sanction is nevertheless necessary, because the exercise of any right entails limitations, sometimes linked precisely to the passing of time. Viewed from the perspective of a third party, forfeiture may mark the end of a period of constraint, of a state of uncertainty regarding one’s own rights. The party who has won the case before the first‑instance court watches with interest the opponent, who has a short time limit—at most 30 days in civil matters—to challenge the judgment that is unfavorable to them.
