Summary/Abstract: Modern criminal procedure and anti-corruption laws rely predominantly on financial investigations, monitoring of cash flows and proving the acquired property benefits. These mechanisms are developed on the assumption that corruption involves the direct exchange of money, real estate, cars or other forms of property benefits, which allows the use of tools such as forensic accounting, transaction monitoring and analysis of property records of public officials. Unlike classic, financially measurable corruption, in the phenomenon of non-cash corruption there is no monetary transaction, nor a direct increase in the assets of the participants. Instead, the corrupt agreement manifests itself through intangible, but useful benefits in exchange for loyalty and political support. Such practices do not leave recognizable traces in financial flows or cause measurable changes in the property situation that would be registered by standard mechanisms of supervision and control. The aim of this paper is to present and define the concept of Non-Pecuniary Corruption as a new alternative approach to understanding contemporary forms of corrupt behavior, by analyzing its characteristics and the institutional context in which it occurs. This paper proposes a conceptual shift - directing the investigative focus to non-property forms of acquired benefits as a starting point for detecting corrupt acts.
