Summary/Abstract: The timesharing treaty, as a consumer contract, represents one of the attractive tourist transactions, offering consumers the use of accommodation units in exotic centers around the world. In order to get the right to use the accommodation unit according to this contract, the consumer is obliged to pay the seller the total usage fee in advance for using the unit for the entire contract period. By issuing the Directive 94/47/EC on consumer protection regarding certain aspects of the contract on acquiring the rights to use properties based on timesharing, the EU tried to protect consumers when entering into these contracts. After issuing this Directive, the tourism was taking an increasingly significant role in the economy of member states and the timesharing sectors should be encouraged to greater growth in such a way that member states acquire certain common rules related to all timesharing contracts. Because of those and similar reasons, the EU acquired the Directive 2008/122/EC on consumer protection on 14 January 2009 regarding to certain aspects of time-divided use of immobility, long-term holiday products, resales and replacements, which represents a directive of maximum harmonization. This Directive tried to ensure the equal treatment of sellers in all member states, which contributes to greater legal security for both, consumers and sellers.
