Summary/Abstract: While general procedures imply a single set of general rules, special administrative procedures imply special rules of administrative procedure in the process of adopting administrative acts. Deviations from the general administrative procedures are numerous and varied. This has led to the emergence of a large number of special administrative procedures. A major challenge facing local authorities is the problem of illegal construction. Tackling illegal construction is above all an indicator of good governance. It is also a point of reference how local authority works to serve citizens at various levels, from local to national. Illegal constructions are legalised using a special administrative procedure, whereby an appropriate act is obtained to legalise an illegally constructed structure. This paper critically analyses the special administrative procedure in the field of legalisation of illegal constructions. It identifies the factors that lead to the inefficiency of this procedure and defines concrete proposals for its improvement.
