Summary/Abstract: This paper examines the legal regime governing pleas of lack of jurisdiction in criminal matters, starting from examples drawn from recent judicial practice that highlight major challenges, such as the stabilization of jurisdiction after the completion of the preliminary chamber procedure, the inability of the preliminary chamber judge who has declared lack of jurisdiction to rule on the motions and objections raised, as well as the correct interpretation of the conditions for the prorogation of jurisdiction of specialized structures. The analysis addresses in detail the moment when territorial lack of jurisdiction may be invoked, the effects of a finding of lack of jurisdiction in the preliminary chamber, and the limits of the special jurisdiction of criminal investigation bodies, including the application of jurisdictional prorogation. The conclusions emphasize the need for a rigorous application of jurisdictional rules, the decisive role of judicial review, and the imperatives of legislative intervention aimed at harmonization, so that pleas of lack of jurisdiction remain an effective instrument for safeguarding legality and ensuring legal certainty in criminal proceedings.
