Summary/Abstract: Having become an indispensable component of every field of activity, digitalisation offers advantages that cannot be denied. However, when the activity is no longer carried out by a human being, but by a system based on algorithms, this may lead to errors and entail certain risks, causing damage to the beneficiary of the respective act. This study aims to identify and analyse whether and how civil liability can be engaged for artificial intelligence, namely whether we can speak of fault-based liability or, on the contrary, of strict liability, independent of the existence of fault. The current legislative framework does not reflect a clear and rigorous system for engaging civil liability for damage caused by artificial intelligence. Therefore, the intervention of the legislator by adapting legislation to these imminent digital changes must take shape as a response in support of guaranteeing the safety of legal relationships, as well as the possibility of compensating any potential damage.
