Summary/Abstract: The data communicated by the Traffic Directorate of the General Inspectorate of the Romanian Police (Address No. 297.668/10 October 2025, transmitted under Law No. 544/2001) reveal an alarming reality: in 2025, 39,953 persons were detected driving under the influence of alcohol or other substances, and 2,839 serious accidents involved drivers in this condition. These figures highlight not only the relatively high frequency of driving under the influence, but also its potential impact on the severity of road incidents—an essential element in assessing the rigidity of passenger protection and in justifying a cautious approach to attributing concurrent fault. The broader topic of protecting passengers involved in road accidents lies at the intersection between the European standard of protection in the field of compulsory motor third‑party liability insurance and the national regime of tort liability, regulated separately by the legislation of each Member State.
