Summary/Abstract: Civil Judgment No. 1 of 19 March 2025, delivered by the Constanța Court of Appeal – First Civil Division, concerns the resolution of a challenge brought by the claimant (a lawyer listed in the register of incompatible/suspended lawyers) against a pecuniary obligation imposed on him under UNBR Decision No. 50/12.12.2015. This obligation had been implemented at the level of the Prahova Bar through Address No. 4205/07.12.2016, by which the claimant was requested to pay a fee of 200 lei per year as a “Prahova Bar expenses fee for maintaining the lawyer on the Register of Incompatible/Suspended Lawyers.” The Address was upheld by Prahova Bar Council Decision No. 11/06.02.2017, through which its legality was challenged administratively. The judgment proposed for analysis is of interest both to lawyers listed as suspended/incompatible and to Bar Associations in Romania, given that although the court of first instance found UNBR Decision No. 50/12.12.2015—under which this fee was established—to be lawful, on the grounds that the UNBR had the competence to set the maximum ceiling for such a fee, Address No. 4205/07.12.2016 and Prahova Bar Council Decision No. 11/06.02.2017 were nevertheless annulled on the basis of insufficient reasoning.
