Sub-concession of public property. A legislative novelty?

Summary/Abstract: This study aims to analyze the sub concession of public property goods, a legal institution introduced in the Administrative Code through a recent amendment, respectively Law no. 115/2024. Although this method of exploiting public property may seem like a legislative novelty for the Romanian legal system, it is, in fact, a legal institution introduced by the Romanian legislator following the old regulatory framework. This atypical situation requires some clarifications, starting from the legal nature of sub concession and extending to the issues it may generate in practice. The study presents, in a concise manner, the implications of this amendment on the exercise of public property rights, beginning with the evolution of sub concession, an institution that has not received thorough analysis from legal doctrine or jurisprudence.
