Summary/Abstract: The principle of loyal cooperation, as part of public law, has an overwhelming impact on state governance and administration, as it is an essential vector in carrying out, faithfully and in good faith, the duties/legal competences/obligations provided by law. With the meaning of behavior based on mutual respect, conduct favorable to citizens and their rights, the principle of loyal cooperation implies fidelity to the rule of law (a state governed by the rule of law), the foundation of constitutional democracy, and involves collaboration between state powers, cooperation between the administration and the other powers, cooperation with citizens in the effective realization of their rights ‒ collaboration, rather than separation. From the perspective of administration and, consequently, of justice, the principle of loyal cooperation is a guarantee for fulfilling the role of public administration, for the proper functioning of society, and for the effective realization of fundamental rights and freedoms. Loyalty works in both directions, being a requirement that concerns the activity of the administration as well as the conduct of those being administered.
