Methods of assessing damages in trademark counterfeiting cases

Summary/Abstract: The method for assessing damages in matters of counterfeiting has always been a complex issue for specialists concerned with combating counterfeiting, as well as for courts of law tasked with evaluating the evidence that substantiates the extent of the damages claimed by the rights holder. In the same context, it also represents a challenge for a lawyer who must demonstrate before the court the scope of the damages that the court is to award for the act of counterfeiting. In this article, we have sought to explain the method for assessing material damages accepted by the court in Civil Case No. 2c-757/2020, in the hope that it will become a relevant judicial practice for the courts of the Republic of Moldova.
