Summary/Abstract: The article analyses, from a comparative law perspective, the application of copyright exceptions in the process of training generative artificial intelligence models in the European Union and the United States. The study examines the difference between the flexible fair use doctrine in American law, exemplified by the Anthropic case, and the formalised EU regulatory framework, focused on the text and data mining (TDM) exceptions in the DSM Directive, exemplified by the LAION and GEMA cases, in which the conditions of permanent storage in LLMs are assessed. The conclusions flag the importance of strategic licensing for ensuring legal certainty and a balance between technological innovation and fair remuneration of creators.
