Summary/Abstract: About ten years ago, digital assets seemed to us a mere technological curiosity; today, they are part of our everyday reality, possessing indisputable economic, legal, and hereditary value. The gap that has emerged between social reality and legal norms creates a dangerous void: both legal professionals – notaries, lawyers, courts – and heirs are confronted with situations that, for the time being, remain unclear. This work undertakes an analysis of the legal regime applicable to the transmission of digital assets through succession, examining the existing legislation in the field at the national level, in private international law, and at the European level. It also defines and classifies digital assets, their nature and specific legal regime, as well as the particularities encountered within each category, with special emphasis on the regime of cryptocurrencies, the underlying technology, and the ways in which they operate. It is absolutely necessary for inheritance regulations, both national and international, European to be adapted to this new reality, which, moreover, represents the main motivation for the present scientific endeavor.
