Summary/Abstract: Article 12 para. (2) of Council Directive 2004/80/EC of 29 April 2004 relating to compensation to crime victims must be interpreted as precluding a national system of compensation for victims of violent intentional crimes which, in principle, excludes, as regards non-pecuniary damage, any compensation for the pain and suffering suffered by those victims. Despite the need to ensure the financial viability of national compensation systems, which means that it is not necessarily for the Member States to provide for full compensation for the material and non-material damage suffered by the victims concerned, fair and adequate compensation within the meaning of that provision requires, when determining such compensation, account to be taken of the seriousness of the consequences for the victims of the offences committed and of the compensation which such victims are likely to obtain, on the basis of tortious liability, from the perpetrator of the offence.
