Decision of the Constitutional Court of Romania no. 297 of 29 May 2025 on the exception of unconstitutionality of the provisions of art. 3 paragraph (2), of art. 6 paragraph (1) letter d) and of art. 12 paragraph (6) of the Law no. 176/2010

Summary/Abstract: The Court established that the provisions of art. 3 para. (2) of the Law no. 176/2010 on integrity in the exercise of public duties and dignities, for the amendment and completion of the Law no. 144/2007 on the establishment, organization and functioning of the National Integrity Agency, as well as for the amendment and completion of other normative acts are constitutional to the extent that they do not also refer to the rights and obligations of the declarant's spouse, as well as of the adult children in his/her care. The Court established that the provisions of art. 6 para. (1) let. d) and art. 12 para. (6) of the Law no. 176/2010 on integrity in the exercise of public duties and dignities, for the amendment and completion of the Law no. 144/2007 on the establishment, organization and functioning of the National Integrity Agency, as well as for the amendment and completion of other normative acts are unconstitutional.
