Some aspects regarding the extension of the in rem criminal prosecution, according to art. 311 par. (1) of the Code of Criminal Procedure

Summary/Abstract: The article aims to issue conclusions related to the issue of the need of extending or not the in rem criminal prosecution regarding strictly the hypothesis of identifying, during the in rem investigations, of other participants in the act for which the criminal prosecution was initiated, by presenting the arguments for and against the extension, finally the authors rallying to the hypothesis against, by attempting to identify the real intentions of the legislator, strictly related to the specifics of the in rem criminal prosecution phase, the essence of which is the investigation of the act and not of the person.
