Perspective on the legal examination of the indictment

Summary/Abstract: This article seeks to analyze the object of the legal examination of the indictment, presenting a perspective on the difference between the notions of „legality” and„regularity” of the indictment. For this purpose, in the first part of the article there will be analyzed the legal provisions, doctrinal interpretations and expert opinions, respectively the evolution of the case law developed in the field of verifying the legality of the indictment. In the second part, there will be analyzed the legal conditions regarding the legality of the disposition of referral to court, as a component of the legal examination of the indictment.
