Summary/Abstract: This article aims to analyze one of the two normative approaches outlined in the former Criminal Code regarding fraud in agreements, specifically the act of maintaining someone in a state of error during the conclusion or execution of contracts, in light of the incriminating provisions of the Criminal Code in force. Considering that the current Criminal Code no longer separately criminalizes fraud in agreements (without, of course, thereby decriminalizing the act itself), and that the current incriminating text addresses only acts of deception rather than acts of maintaining someone in error, it is useful to assess whether, in this context, the criminal offense of fraud can still be perpetrated by maintaining the passive subject in a state of error.
