Summary/Abstract: The nature of the legal limits to which the right to property is subjected, between neighbours, is a controversial matter. This paper analyses both the 1864 Civil Code and the Civil Code in force, in order to determine the legal regime of legal limitations and easements, namely: their means of creation, exercise, opposability and disuse. Furthermore, this paper analyses the legal remedies applicable in case of breach of the law regarding legal limitations and the statute of limitations for the action aimed at compensating the damage caused.
