Summary/Abstract: The compulsory nature of the most significant procedural acts used to fulfil the responsibilities arising from judicial functions is, without doubt, an intrinsic feature of procedural criminal legal relations. Consequently, the institution of procedural measures constitutes one of the fundamental pillars of criminal procedure, irrespective of the predominance of differing influences, continental or adversarial, that shape its systemic evolution at a given moment. Although they do not fully align with the scope of "criminal matters" in their autonomous European sense, precautionary measures, as a subset of procedural measures, retain all the defining characteristics of their category. The significant impact on individuals’ patrimony, including those who, at times, lack procedural standing, the occasionally antagonistic relationship with preventive measures, the most prominent category of procedural actions, and the procedural rationale overlapping between the two judicial actions represent some of the functional challenges posed by the contemporary application of precautionary measures in criminal law. This study aims not only to review these current challenges in detail but also to offer suitable solutions to recently emerging doctrinal and jurisprudential debates.
