Summary/Abstract: Good faith is a fundamental principle that underlies the entire contractual process, from negociation to execution. However, its application varies in scope and intensity throughout these different stages. In the pre-contractual negociation phase, good faith has an absolute and irreducible scope, making it impossible to separate from this stage. In contrast, during the contractual phase itself, good faith has a more moderate and relative scope, allowing for the possibility of separation.
