Summary/Abstract: The criminal process can be represented as an activity of discovering, presenting, assessing, and using documents, as well as the drafting and preparation of several documents that are legally significant. The paradox, however, lies in the fact that, due to its importance, prevalence, and frequency of use, this concept belongs to a category of notions that are evidently underdeveloped and insufficiently researched, both in criminal law and procedural law theory, as well as in criminology theory. As a result, there is a discrepancy between opinions regarding the content and scope of this concept, with textual and conceptual differences in its definitions published in the specialized literature, reflecting the viewpoints of various authors. Criminological researchers from several countries have always paid great attention to studying the different types of documents used in the criminal process, as well as to the development of recommendations for discovering, recording, examining, seizing, and investigating them in judicial expertise, and, respectively, using them in the evidentiary process. However, the effectiveness of scientific research in this field and the implementation of the obtained results in practice could be higher if we relied on a more comprehensive knowledge of documents and the objects associated with them, on the provisions, principles, and approaches that are important for all cases of collecting, assessing, and using documentary evidence in the investigation and discovery of criminal facts.
