Summary/Abstract: The article examines the legal and procedural challenges arising from the cross-border enforcement of road traffic offences. Starting from the premise that traffic safety is a shared European objective, the study analyses the mechanisms established by Directive (EU) 2015/413 on the exchange of information concerning road safety-related traffic offences and their implementation in Member States. Special attention is devoted to the procedure of documenting offences committed by non-resident drivers, the evidentiary value of automated enforcement systems, and the harmonization of procedural guarantees ensuring the right to defence. The research highlights the need for a balance between administrative efficiency and the protection of fundamental rights, particularly data protection and the presumption of innocence. Comparative analysis between national legal frameworks reveals both progress and persistent divergences in practice. The paper concludes by proposing several directions for improving mutualrecognition of evidence and enhancing cooperation between competent authorities, with the aim of achieving a more coherent and fair system for documenting and sanctioning road traffic offences across the European Union.
