Summary/Abstract: Commodity futures contracts play an important role in modern financial markets as instruments of risk management. These contracts oblige the parties to buy or sell a specified commodity at a predetermined price on a future date. Such transactions are carried out both in organized commodity futures exchanges as well as in over-the-counter markets. Following the collapse of the Bretton Woods system, extreme fluctuations occurred among national currencies, which in turn led to significant volatility in commodity prices. Individuals and legal entities have therefore used commodity futures contracts for such purposes. Various measures are taken in the exchanges where these contracts are traded in order to mitigate counterparty credit risk. One of these measures is the requirement of margins from the parties. Although margins appear technically rational and efficient, the Sharīʿah status of this structure is subject to scholarly debate. These debates focus on the nature of margins, their use, and the essence of the daily mark-to-market mechanism. This study aims to examine the margin system in futures contracts from the perspective of Islamic law and to provide a Sharīʿah assessment of its implementation in Turkish commodity exchanges. In this system, the positions of the parties are revalued daily based on market prices, and the resulting price differences are reflected in the margin accounts as daily profits or losses. This situation is associated by some Islamic jurists with impermissible forms of gain and is criticized for resembling murāhana (gambling/betting). The article aims to evaluate the margins collected from both the buyer and the seller, as well as the Islamic legal interpretations related to daily mark-to-market adjustments, thereby seeking to determine the Sharīʿah legitimacy of the margin system used in Turkish futures exchanges. The analysis concludes that the margins in question bear the characteristics of collateral (rahn), while the daily mark-to-market mechanism resembles impermissible forms of gain and murāhana. The article is significant in that it clarifies certain conceptual confusions in the literature regarding margins and identifies the Sharīʿah aspects of the margin practices in Turkish commodity exchanges.
